Terms of Use — Arboreal Forest

1. About these terms
1.1 These terms apply between you and Arboreal AB, Strandvägen 2C, 922 63 Tavelsjö, Sweden ("Arboreal", "we", "us"). They apply when you use the Arboreal Forest app (called Arboreal Skog in Sweden) and the web portal on arboreal.se where you view your measurements (together, the "Service").
1.2 By creating an account or using the Service you accept these terms. How we handle personal data is described in the Privacy Policy.
1.3 If you use the Service through a company that has an agreement with Arboreal, that agreement also applies. Where the agreement differs from these terms, the agreement prevails.
2. The Service
2.1 With Arboreal Forest you measure trees and plots with your phone's camera, AR and, on devices that have it, lidar. The app calculates, among other things, diameter, basal area, volume and stems per hectare.
2.2 You may use the Service both privately and in your work, for example for forest inventory, valuation and planning.
3. Account
3.1 You need an account to use the Service. The information you provide must be accurate.
3.2 Your account is personal. Keep your password secret. If you suspect that someone else can access your account, change your password and email support@arboreal.se.
4. Subscriptions and payment
4.1 You can try all features for free in the app. If you want to keep using the app after the trial, you choose a weekly or monthly subscription. Current prices are shown in the app and in the App Store or Google Play.
4.2 Purchases are made through the App Store or Google Play. Apple's or Google's terms apply to payment, refunds and the right of withdrawal.
4.3 The subscription renews automatically until you cancel it. You cancel it in your account settings in the App Store or Google Play, at least 24 hours before the period ends. The subscription then remains active until the end of the period.
4.4 Deleting your account or the app does not cancel the subscription.
4.5 Companies can sign a company licence directly with Arboreal. The terms of that agreement then apply to price and payment.
5. Company accounts
5.1 If your company has an agreement with Arboreal, the company's administrators can add and remove users, see the users' measurements and create API keys to fetch them.
5.2 The company is responsible for how it uses the measurements and for informing its users about it.
6. Your measurements and images
6.1 Your measurements belong to you, or to your company if you have agreed so.
6.2 You give us the right to store and process your measurements in order to provide the Service: to show them to you, to your company and to holders of an API key you have created.
6.3 Images are saved according to your choice in the app (0, 10 or 100 %). The images may be used to improve Arboreal's recognition of tree species and tree edges. We do not share them with anyone else for training.
6.4 We may use aggregated statistics that cannot be linked to you or your company to improve the Service.
7. How you may use the Service
You may not:
- share your account with others or use someone else's account
- circumvent payment, sign-in or other restrictions in the Service
- overload, disrupt or try to break into our systems
- decompile or reverse engineer the app, except to the extent the law allows
- spread malicious code through the Service
- use the Service in breach of the law
If you breach these terms we may suspend or close your account.
8. Measurement accuracy
8.1 The measurements are estimates. How accurate they are depends on, among other things, the device, light, terrain and how the measurement is made. Results from our evaluations are available on arboreal.se.
8.2 Check important results in another way before making decisions based on them alone, for example in timber sales.
9. Availability and changes to the Service
9.1 We develop the Service continuously and may add, change or remove features.
9.2 We aim for the Service to always work, but cannot promise that it is always available or free of errors.
10. Liability
10.1 We are not liable for indirect loss, such as loss of profit or business, or for loss caused by measurements being used without the checks described in section 8.2.
10.2 These limitations do not apply in cases of intent or gross negligence, or to personal injury.
10.3 If you are a consumer, you always keep the rights that follow from mandatory law, including the rules on digital content and digital services. These terms do not limit those rights.
11. Ending
11.1 You can stop using the Service and delete your account in the app at any time. See Delete account — Arboreal Forest.
11.2 We may close your account if you seriously breach these terms.
12. Changes to these terms
We may change these terms. We announce significant changes in the app or by email before they take effect. If you continue to use the Service after that, the new terms apply. If you do not accept them, you can delete your account.
13. App Store and Google Play
13.1 These terms are between you and Arboreal, not Apple or Google. Arboreal, not Apple or Google, is responsible for the app, its content, support and maintenance.
13.2 Apple and Google have no obligation to provide support for the app. If the app fails to meet a warranty that applies by law, you can contact Apple or Google for a refund of the purchase price. Beyond that, they have no warranty obligation for the app.
13.3 Apple, Google and their subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13.4 You confirm that you are not located in a country subject to a US embargo and are not on any US list of parties prohibited from receiving services.
14. Governing law and disputes
14.1 Swedish law applies to these terms. Disputes are settled by the general courts of Sweden.
14.2 If you are a consumer in Sweden, you can also turn to the National Board for Consumer Disputes (ARN), arn.se. If you live in another EU country, you keep the protection that mandatory law in your country gives you.
